First off, I am sry for the loss of your wife and the troubles that you are having with the taxes. In the "great" state of New York you can't count on anyone to get the tax collections dept. or really any dept. to help you unless it's in their favor. I had a check due to me for a "mistake" the state made with reguards to 2006 return and it wasn't 'till June of '07 that I finally recieved my check. I had to laugh becuase if I had owed them money and didn't pay for that amount of time i'm sure they would have found it their duty to fine me and it makes me wonder-Why can't we fine them for the same things they can fine us for? Take care and God bless!

I'm not sure if you'll still check this since it's been a few days but I thought I'd make a suggestion. I know people think CPAs and other accountants are ridiculously expensive, but sometimes it takes one to get your tax problems solved. I am a new CPA and have noticed that when a client tries to solve a tax problem by themself it causes much aggravation. All who eventually come for help seem to feel much better in the end. I'm not touting my services, but it may be worth looking for some professional help in this case. Good luck!!

That is truly awful...and got me really fired up. It isn't just the state...my mom kept getting a bill from the Town of Greece for a $6.00 dog license after she had contacted them 3 different times and the dog had been gone for 2 years. I know it isn't the same, but it just goes to show that when an organization has so many working parts...they work fine independently but none of them work well together.
Anyways...I think I might have a solution to your problem. What bank was the DBA at, and did she pay her quarterly taxes at the bank or directly to the govt at the end of the year? I would try to have the bank contact them and prove that she was current up until the point where she claimed $0 income- which meant she owed nothing, and then when and why it was closed. Sometimes govt offices take the bank's word more seriously than an individual. They have this underlying belief that everyone is trying to scam their way out of paying taxes...and unfortunately the few that truly aren't trying to get away with something suffer!
